TERMS OF SERVICE AND PRIVACY POLICY

Terms of Service

These terms define the relationship between you and BoPeep. When we speak of “BoPeep,” “we,” “us,” and “our,” we mean BoPeep LLC and its affiliates, as well as BoPeep’s employees, officers, members, and owners. We give you permission to access and use our Services (i.e. any services offered by BoPeep) only if you agree to follow these terms.

Privacy

BoPeep does not sell, rent or monetize your personal data or content.

After the deadline to sign a petition is met, BoPeep automatically deletes most information that does not appear on the face of the petition within two weeks.

When you create a petition, data linking your account to the petition is retained until you decide to delete the petition.

Notwithstanding the foregoing, BoPeep cannot guarantee that any particular type or category of information will be deleted.

Under certain circumstances, BoPeep may need to disable its automatic deletion processes in order to comply with applicable laws.

There might also be instances where BoPeep will need to share your data, such as:

  • To meet any applicable law, regulation, enforceable governmental request, or legal process, including but not limited to responding to a subpoena.
  • To enforce applicable Terms, including investigation of potential violations.
  • To detect, prevent, or otherwise address fraud, security, or technical issues.
  • To protect against harm to the rights, property, or safety of BoPeep, our users, or the public as required or permitted by law.

For the purpose of operating our Services, you agree to our data practices as described here, as well as the transfer of your personal information and metadata to the United States and other countries where we have or use facilities, service providers or partners. Examples would be Third Party Providers sending you a verification code and processing your requests.

Using BoPeep. You must be at least 18 years old to use our Services.

Our Terms and Policies. You must use our Services according to our terms and posted policies. If we disable your account for a violation of our terms, you will not create another account without our permission.

Legal and Acceptable Use. We want to maintain a respectful environment for everyone, which means you must follow these basic rules of conduct:

  • comply with all applicable laws;
  • respect the rights of others, including privacy and intellectual property rights;
  • don’t abuse or harm others or yourself (or threaten or encourage such abuse or harm) — for example, by threatening, harassing, misleading, defrauding, illegally impersonating, defaming, bullying, or stalking others; and
  • don’t use our services for advertising.

You agree to abide by these rules of conduct.

If any of your content (1) breaches these terms, (2) violates applicable law, or (3) could harm our users, third parties, or BoPeep, then we reserve the right to take down some or all of that content. Examples include threatening or harassing messages, and content that infringes someone else’s intellectual property rights.

Without limiting any of our other rights, BoPeep may also suspend or terminate your access to the services.

Don’t abuse our services. You must not abuse, harm, interfere with, or disrupt our services or systems — for example, by:

  • introducing malware
  • spamming, hacking, or bypassing our systems or protective measures
  • accessing or using our services or content in fraudulent or deceptive ways, such as:
    • phishing
    • creating fake accounts or content, including fake reviews
  • using our services (including the content they provide) to violate anyone’s legal rights, such as intellectual property or privacy rights
  • reverse engineering our services or underlying technology, such as our machine learning models, to extract trade secrets or other proprietary information.
  • using automated means to access content from any of our services
  • hiding or misrepresenting who you are in order to violate these terms
  • providing services that encourage others to violate these terms

Permission to use your content.  Some of our services are designed to let you upload, submit, store, send, receive, or share your content. You have no obligation to provide any content to our services and you’re free to choose the content that you want to provide. If you choose to upload or share content, please make sure you have the necessary rights to do so and that the content is lawful.

Harm to BoPeep. You must not (or assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorized manners, or in ways that harm BoPeep, our Services, systems, or reputation. For example you must not (a) gain or try to gain unauthorized access to our Services or systems; (b) disrupt the integrity or performance of our Services; (c) create accounts for our Services through unauthorized or automated means; or (d) collect information about our users in any unauthorized manner.

Keeping Your Account Secure. You are responsible for keeping your device and your BoPeep account safe and secure.

Availability of Our Services. Our Services may be interrupted, including for maintenance, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time.

BoPeep’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our written permission. To report copyright, trademark, or other intellectual property infringement, please contact legal@bopetition.com.

Some of our services include content that belongs to BoPeep—for example, our logo. You may use BoPeep’s content as allowed by these terms and any service-specific additional terms, but we retain any intellectual property rights that we have in our content. Don’t remove, obscure, or alter any of our branding, logos, or legal notices.

Fees and Taxes. You are responsible for data and mobile carrier fees and taxes associated with the devices on which you use our Services.

Disclaimers and Limitations
We offer our services without any warranties, as explained in greater detail below. As a reminder, when we say “BoPeep,” “we,” “us,” and “our,” we mean BoPeep LLC and its affiliates, as well as BoPeep’s employees, officers, members, and owners.

Disclaimers. YOU USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES ON AN “AS IS” BASIS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. BOPEEP DOES NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR-FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES. WE ARE NOT RESPONSIBLE FOR THE ACTIONS OR INFORMATION (INCLUDING CONTENT) OF OUR USERS OR OTHER THIRD PARTIES.

WE DO NOT CONTROL OR DIRECT WHAT PEOPLE AND OTHERS DO OR SAY, AND WE ARE NOT RESPONSIBLE FOR THEIR ACTIONS OR CONDUCT (WHETHER ONLINE OR OFFLINE) OR ANY CONTENT THEY SHARE (INCLUDING OFFENSIVE, INAPPROPRIATE, OBSCENE, UNLAWFUL, AND OTHER OBJECTIONABLE CONTENT).

DON’T RELY ON OUR SERVICES FOR LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE. ANY CONTENT REGARDING THOSE TOPICS IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND IS NOT A SUBSTITUTE FOR ADVICE FROM A QUALIFIED PROFESSIONAL.

Release of Liability. YOU RELEASE US FROM ANY CLAIM, COMPLAINT, CAUSE OF ACTION, CONTROVERSY, OR DISPUTE (TOGETHER, “CLAIM”) AND DAMAGES, KNOWN AND UNKNOWN, RELATING TO, ARISING OUT OF, OR IN ANY WAY CONNECTED TO THE SERVICES OFFERED BY BOPEEP.

Limitation of Liability. These terms only limit our responsibilities as allowed by applicable law. These terms don’t limit liability for gross negligence or willful misconduct.

YOU AGREE THAT, TO THE EXTENT ALLOWED BY APPLICABLE LAW, BOPEEP IS NOT LIABLE FOR:

  • LOSS OF PROFITS, REVENUES, INCOME, BUSINESS OPPORTUNITIES, GOODWILL, REPUTATION, OR ANTICIPATED SAVINGS.
  • INDIRECT OR CONSEQUENTIAL LOSSES
  • PUNITIVE DAMAGES

BOPEEP’S TOTAL LIABILITY (INCLUSIVE OF ANY COSTS OR FEES) ARISING OUT OF OR RELATING TO ITS SERVICES IS LIMITED TO THE GREATER OF (1) $200 OR (2) THE FEES PAID TO USE THE RELEVANT SERVICES IN THE 12 MONTHS BEFORE THE DISPUTE.

BOPEEP WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES RELATING TO, ARISING OUT OF, OR IN ANY WAY IN CONNECTION WITH OUR TERMS, US, OR OUR SERVICES, EVEN IF BOPEEP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE FOREGOING DISCLAIMER OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY WILL APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THE LAWS OF SOME STATES OR JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. NOTWITHSTANDING ANYTHING TO THE CONTRARY IN OUR TERMS, IN SUCH CASES, THE LIABILITY OF BOPEEP WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification:
To the extent allowed by applicable law, you’ll indemnify BoPeep and its directors, officers, employees, members, owners, and contractors for any legal proceedings (including actions by government authorities) arising out of or relating to your violation of these terms, or your unlawful use of the Services. This indemnity covers any liability or expense arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees.

Resolving Disputes and Ending Terms

Resolving disputes. New York law will govern all disputes arising out of or relating to these terms, service-specific additional terms, or any related services, regardless of conflict of laws rules. These disputes will be resolved exclusively in the federal or state courts of New York County, New York, USA, and you and BoPeep consent to personal jurisdiction in those courts.

Termination of Use. We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our terms or create harm, risk, or possible legal exposure for BoPeep. The following provisions will survive termination of your relationship with BoPeep: “Privacy,” “Permission to use your content,” “Availability of Our Services,” “BoPeep’s Rights,” “Fees and Taxes,” “Disclaimers and Limitations,” “Disclaimers,” “Release of Liability,” “Limitation of Liability,” “Indemnification,” “Resolving disputes,” “Termination of Use,” and “General.”

General

BoPeep may update these Terms from time to time. When we update our Terms, we will update the “Last Modified” date associated with the updated Terms. Your continued use of our Services confirms your acceptance of our updated Terms and supersedes any prior Terms. Our Terms cover the entire agreement between you and BoPeep regarding our Services. If you do not agree with our Terms, you should stop using our Services.

If we fail to enforce any of our Terms, that does not mean we waive the right to enforce them.

If any provision of the Terms is deemed unlawful, void, or unenforceable, that provision shall be deemed severable from our Terms and shall not affect the enforceability of the remaining provisions.

Our Services are not intended for distribution to or use in any country where such distribution or use would violate local law or would subject us to any regulations in another country.
